rights. CheckOutImages.com reserves the right to use any panoramic or digital
images for promotional reasons in the press, in print publications, or on
the world wide web, without prior permission by the customer.
CheckOutImages.com requires that on every Photo will be watermarked. This
watermark is not to be removed
or altered in any way under no circumstances
unless agreed upon by client & CheckOutImages.com. Failure to conform to this
requirement will result in the customer being liable for any financial
losses incurred by the breach of this requirement.
All copyright for
still photos will remain with CheckOutImages.com. The customer may use the
finished images in what ever manner they like providing that the intended
use is not inappropriate, offensive or insulting. Where photos are to be
published on the world wide web, in the press, or in other publications,
then credit must be given to the photographer (CheckOutImages.com) where
appropriate.
All and any pictures
or images that a client / customer sends or gives to CheckOutImages.com
either by email or in real property will become the property of
CheckOutImages.com. By sending or giving pictures to CheckOutImages.com
client / customer is giving CheckOutImages.com all copyrights to the
pictures / images.
CheckOutImages.com reserves the right to use any panoramic or digital images
for promotional reasons in the press, in print publications, for sales, or on the
world wide web, without prior permission by the customer.
By sending any pictures of images to CheckOutImages.com you are agreeing
and stating that you have all necessary permissions to use the image and
that you own the copyright for the images.
All images and media are
the sole property of CheckOutImages.com. We reserve all rights to these
images, media and content. All images and media are made available to
client until the Event hosting time has expired.
INTELLECTUAL PROPERTY INFRINGEMENT CLAIMS
It is the policy of CheckOutImages.com to respond expeditiously to claims
of intellectual property infringement. CheckOutImages.com will promptly
process and investigate notices of alleged infringement and will take
appropriate actions under the
Digital Millennium Copyright Act ("DMCA") and other applicable

Live Help Policy

CheckOutImages.com Uses the Live Help service
provided by Crafty Syntax Live Help
This service is provided as is and free of charge. We do not guarentee a
live customer service person will be available. When time premits we will
have the service activated and help viewers with tour questions. Any
viewer contacting us from a MLS friendly tour will not be given any
listing information or agent contact information. We will only provide
help viewing the tour.
Below is a copy of the Terms of Service assiciated
with this service. By using this service you accept these Terms of Use and
agree to be legally bound by all of the terms and conditions of this
Agreement.
We may automatically amend this Agreement at any time.
- We may terminate this Agreement or service
immediately for any reason.
- Due to the existing legal and technical environment
of the Internet, we cannot ensure that all of your private
communications and other personally identifiable information will not be
unexpectedly disclosed. By way of example (without limiting the
foregoing), we may be forced to disclose your private communications to
the government or third parties under certain circumstances, or third
parties may unlawfully intercept or access transmissions or private
communications. Further, we can (and you authorize us to) disclose any
information about you or private communications by you to law
enforcement or other government officials, as we, in our sole
discretion, believe necessary or appropriate.
- WE PROVIDE YOUR ACCOUNT AND OUR SERVICES "AS IS." OUR
SUPPLIERS AND WE EXPRESSLY DISCLAIM ALL WARRANTIES OR CONDITIONS OF ANY
KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION THE
IMPLIED WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE. You understand that our services may
be unavailable for extended periods of time, and we do not warrant or
ensure the continuous availability of our services. Some states do not
allow the disclaimer of implied warranties, so the foregoing disclaimer
may not apply to you.
- IN NO EVENT SHALL OUR SUPPLIERS OR WE BE LIABLE FOR
ANY LOST PROFITS OR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES
(HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION
WITH YOUR ACCOUNT OR THIS AGREEMENT. OUR LIABILITY TO YOU OR ANY THIRD
PARTIES IS LIMITED TO $50. Some states do not allow the foregoing
limitations of liability, so they may not apply to you.
- The services hereunder are offered by Bravestorm, LLC
located in Wichita, KS. This Agreement is governed in all respects by
the laws of the State of Kansas. Both parties submit to personal
jurisdiction in State of Kansas and further agree that any cause of
action relating to this Agreement shall be brought in a court in
Wichita, KS. If any provision of this Agreement is held to be invalid or
unenforceable, such provision shall be struck and the remaining
provisions shall be enforced. Our failure to act with respect to a
breach by you or others does not waive our right to act with respect to
subsequent or similar breaches. We shall not be liable for any delay or
failure to perform resulting directly or indirectly from any causes
beyond our control. You consent to us sending you emails, as we deem
necessary. This Agreement sets forth the entire understanding and
agreement between us with respect to the subject matter hereof.

Cancellation and Appointment

To schedule an event a deposit is required, (Nonrefundable) amount
determined by CheckOutImages.com
The customer should book an event or photo shoot well in advance to ensure
date and time.
The customer will sign a contract stating they understand all copyright
and arrangements.
Any cancellations will forfeit the event deposit.
A customer may reschedule a photo shoot but must do so prior to 48 hours before
the scheduled appointment. If less then 48 hour notice customer will be
charged a reschedule fee.
Failure to do so will result in a cancellation or rescheduling fee.
Once
the photographer has arrived at the property, the event may not be
cancelled. The client will be charged the full price of the event.

Payments and Refunds

A deposit is required to book an event. Balance is
required at time of shoot.
Payments need to be in the form of a Check, Money
order or cash. *Checks need to be made out to the photographer.
Refunds, Due to the nature of our business we
do not offer refunds in any form. CheckOutImages.com is a service based
business. After the service and man hours have been completed we are not
in a position to refund any payments for any reasons. However it is our
practice to completely satisify each customers concerns. We may at our
option issue credits to customers on future events if deemed appropriate.

information about our customers. Personal information includes all of the
personally identifying information that is provided to
CheckOutImages.com
CheckOutImages.com is sensitive to
these privacy interests and believes that protecting valuable
personal/financial information is one of our most significant
responsibilities.

Use, Collection and Retention of Client Information
CheckOutImages.com collects, retains and uses only the information about
our customers that is required by law to administer the business and
provide high-level services to our clients. We retain this information no

CheckOutImages.com has established procedures so that a client's financial
information is accurate, current and complete in accordance with
reasonable commercial standards. Any request to correct inaccurate
information is responded to within a timely manner.

of privacy and confidentiality. Only those representatives having a
business reason for knowing such information have access to personally
identifiable information.

If it is necessary to provide personally identifiable customer information

keep about them and how the information is used. Customers have the right
to have any inaccurate information corrected or deleted.

Spam Policy
Spam is flooding the Internet with many copies of the same message, in an
attempt to force the message on people who would not otherwise choose to
receive it. Email spam targets individual users with direct mail messages
and costs the sender very little to send. Most of the costs are paid for
by the recipient or the carriers rather than by the sender.
CheckOutImages.com doesn't condone the use of spam and the sending of
unsolicited email in any form, nor do we control other web sites
involvement and/or practices in this area. Any agent that is using our
services or the visitor login information for any other purposes other
than sending the viewer a thank you letter for viewing your listing will
be in violation of our no spam policy.
